The People bring this appeal (Pen. Code, Â§ 1238, subd. (a)(7)) from the order dismissing the case against defendant who was charged with bookmaking (Â§ 337a). The dismissal was entered after the prosecution represented that it could not proceed due to the granting of defendants motion to quash a search warrant and suppress evidence (Â§ 1538.5). The first issue before us is whether the warrantless search of the defendants apartment buildings trash bin constituted an unreasonable search and seizure. We conclude that it did for lack of probable cause. The second issue is whether a police officers affidavit provided probable cause for the issuance of the search warrant authorizing the search of defendants
